There was a time before the 1st impeachment, when Trump (POTUS) stated -publicly- that he had declassified all records and had left the release of them up to the discretion of AG Barr.
That is a pretty broad statement of DECLAS, long before he boxed them up and took them to FLA.
There is, tho, the [DECLAS] of military documents which HE ALONE could classify and declassify.
I would say that these docuemnts are not part of the PRA, which makes no mention of the CinC records...there is no Commander-in-Chief Records Act.
I will stress again, the Constitution recognizes 3 branches of Government.
It does not create or codify a “military”.
To my knowledge, it is referenced ONLY in the Commander-in-Chief clause and the 2nd Amendment.
Further, Congress meets to certify the President and Vice-president. They do NOT certify or confirm the CinC.
The military and command thereof is looming large, lately.
And no, I don’t think Trump is CinC, but he did “vest” a citizens panel for reasons of Continuity of Command through PEADs.
