In New York City, everybody but the richest few percent rides the subway, and they know how bad things have gotten in the wake Manhattan DA Alvin Bragg treating arrests as inequitable since African Americans are disproportionately arrested.
Jordan Neely died in a hospital after being subdued by Marine Corps veteran Daniel Penny with the help of two other passengers (who have not been charged).

Neely “avoid[ed] prison for allegedly slugging a 67-year-old woman in November 2021 during a psychotic episode” by agreeing to a plea deal. Despite a record of more than forty previous arrests, he was allowed to roam the streets, though he was to stay at Harbor House, where he could receive services. When he left there, Manhattan Supreme Court Justice Ellen Biben signed a warrant for his arrest on February 23.
Perhaps because police officers realize that arresting any black person can cause enormous career grief, Neely evaded arrest, even while riding subways and being visible on the streets. The justice system, in other words, completely failed to protect the public from a deranged, violent man. So, when riding the subway on May first and threatening passengers with violence, and assaulting some by throwing trash, it was only Daniel Penny who first took action to protect himself and fellow passengers.

The charge is not murder, but manslaughter in the second degree.
He's thinking "I went to jail, so should you". But Goetz said to one of his assailants who he had shot "You don't look so bad" and shot him again. That's probably why he was convicted.
The moral is, finish him off only if there are no witnesses.
Goetz was acquitted of all charges except illegal gun possession. The jurors probably wished he killed all four of those losers instead of just wounding them.
The truth is that Alvin Bragg does not care about Jordan Neely. He cares about this because Daniel Penny was white and this can be used by the marxist left to stir up racial division before the next election.
In NYC it is illegal to carry a gun without a permit. They only issue permits if you are driving a Brinks truck with cash to banks or something like that. That is what Goetz was convicted of.

And I am sure that Penny knew nothing of the 40 prior arrests when he put Neely in a chokehold for crazy talk and verbal threats. Under NY law (and the law in most states) deadly force can only be used in response to an imminent threat of death or serious bodily injury. Mere frothing at the mouth and verbal threats do not meet that standard.
It isn’t like Penny shot Neely. He restrained him. Neely may have died as a result of choking or drugs, but Penny did not intend to use deadly force.
There are reports that Penny continued the chokehold for 45 seconds after Neely lost consciousness and crapped his pants, and he continued the chokehold after by-standers warned Perry that he was killing Neely. While I agree that Penny did not intend to kill, there is certainly probable cause to arrest, charge, and present the case to a grand jury. But again, even if Penny did not intend to use deadly force, the question remains as to why Penny used physical force of any kind when by all accounts Neely did not attempt to physically harm anyone. NY law does not allow the use of non-lethal physical force to stop a person from spitting, cursing, verbal threats, and similar anti-social behavior that does not involve physical contact or attempted physical contact.
The point of my post was that if the justice system had done its job he’d probably be alive, not that the Marine was right or wrong.

We can agree on that. Clearly a failure in a system that is set up to fail — thanks’ to Mario Cuomo.
