The federal public health emergency has been in place since early 2020, and it gave federal and state governments flexibility to waive or modify certain requirements in a variety of areas.

Please note that, for the Employee Retention Credit, the IRS specifically states that there was NO federal employment requirement, but that all restrictions came from local governments. (ERC is what all of those ads from legal mills are promoting on radio and TV).
