Man interrupted dinner date to kill parking lot scammer over $40, police say

Erick Aguirre, 29, was arrested north of Corpus Christi, Texas Tuesday, the New York Times reported. He is charged in connection with the April 11 death of 46-year-old Elliot Nix in Houston. He was jailed on a $200,000 bond after an arraignment Thursday.

Aguirre and his date, Melanie Castillo, arrived in separate cars for a date at a restaurant called the Rodeo Goat on the night of the shooting, according to the Times.

Once they parked, a man approached them to pay a $20 parking fee each car. Aguirre paid, and the couple went on to the restaurant. When they got to the Rodeo Goat, a worker told them the seeming parking attendant was actually a "scammer."

Castillo, who voluntarily gave a statement to police two days after the shooting, reportedly said Aguirre "sprinted" back to the cars while she waited outside the restaurant.

A witness from a nearby smoke shop told police he saw Aguirre pull a pistol from his car. Next, he heard a gunshot, saw Aguirre return to the car with the gun, then saw Aguirre go back to Rodeo Goat, according to the Times' review of court documents.

Castillo, the woman on the date, said Aguirre told her he "just scared the guy." The pair went inside the restaurant, only to leave shortly after when Aguirre suggested going someplace else.

"She was devastated to learn of the death," Castillo's attorney, Rock DeToto, told the Times. He added that Castillo was "shocked to see a photo of herself on the news and to hear that she was a person of interest."

"The penal code in Texas, and in 49 other states, and in most civilized countries, doesn’t give you any legal basis to shoot and kill someone who ripped you off," legal analyst Brian Wice told KPRC.

Certainly it is.

It shows career criminals, even petty ones , commit financial loss and misery to a great total sum. That killing them would lessen the evil in the world.

That is independent of the questions about morality, law or , mental health.

20 years ago I believe we had more of a justice system for all. I suggest many people you and Spetnaz are referring to as bad or evil (or whatever) are simply losing faith in a legal system like we see in LA or San Fran or New York.

When the government only calls hate crime 90% of the time for 1 color, or let’s thieves go who steal under $900 (or whatever San Fran was doing) or let older teens go with a slap on the wrist for punching out elderly people in the knockout game they become despondent and desperate.

Desperate people don’t think or talk in measured ways. IMO.

Yes, he’s got a problem with that “immediately” bit, but he could try to argue that he pursued the thief immediately after learning it was a theft. Weak, and I don’t think a jury would buy it....but wasn’t my point.

Texas law absolutely does allow deadly force in defense of property, including mere theft, albeit during nighttime hours. A stretch to apply that here, but the statement on its face is incorrect.

To speak of ways to lessen evil in the world is a moral agenda. It contains the unspoken imperative, “this should be done.”

You have the right to do this. But as a moral imperative, it’s mentally retarded in that it calls for murder as a solution for petty theft.

You remind me of those others that believe in flat earth. They make these elaborate confounded plots in their minds to prove that which is unprovable.

I shared my opinion that there are 2 sides. Killing the man is obviously wrong yet career criminality , where petty theft is the method, causes great harm to society. By the criminal getting killed it lessens evil. Rather than seeing other alternative reactions to my argument you immediately accuse me of calling for the most radical one ie Im calling for a “mentally retarded….murder for petty theft”.

Actually what I really had in my mind was reduced sentencing for the offender. But no you go ahead and to show your mean spirited, bullying behavior (sadly too common here). Then to prove your intent is to belittle and bully you associate me with the following terms as well:
Mind control criminal
Deep state
Induce behaviors contributing to moral destruction of our country

In fact you are being argumentative, insulting and demeaning.

The deep state does the opposite of what I’ve done. They fool their intended audiences through media, education etc to be entertained or educated while they slyly sneak their counterculture messages though. I freely and openly stated my mind and opinion—killing a career criminal is wrong but will lessen evil.

You’ve insulted me and wrongly accused me of working with deep state and I hate you for it.

MODERATORS I HOPE YOU SEE THIS.

I have a hard time believing you feel bullied, unless you were born after 1980.

And I must admit, a similar vein courses through my thoughts, that I would like to see repeat offenders thwarted, even by violence.

But I know it would only follow other moral declines in our nation.

These moral declines are the theme of my message, and they are the result of mind control. The mind control we’ve suffered, including you, dwarfs the evil of petty theft.
