Cletus, it’s the other way around. All of us know in our hearts that it’s a fishing expedition. But the accused never have to prove their innocence. Instead, it’s incumbent on The People, as represented by the prosecutor, to prove the accusations beyond a reasonable doubt. Both side are entitled to the same information. That is discovery. In discovery, this will all be shown to be the fishing expedition that we all suspect. There is no separate due process for “fishing expeditions.”
