The city should just pay up, even if it’s just for the PR. A 2007 BMW 328 isn’t worth all that much anyway.

Her lawyer needs to wise up and sue them under ‘eminent domain takings’. They need to pay for the ‘taking’ they did in trashing this lady’s car.

The Takings Clause of the Fifth Amendment to the United States Constitution reads as follows: “Nor shall private property be taken for public use, without just compensation.” In understanding the provision, we both agree that it is helpful to keep in mind the reasons behind it.

I wonder about that as well.

Also when I have have had car accidents, my insurance company handled everything. My insurance company dealt with the insurance company of the other driver.

Maybe not all insurance companies do business that way? In any event I had my vehicles repaired, and then my insurance dealt with the other driver’s Insurance to be reimbursed.

There was an occasion several decades ago when an Arlington County patrol car in hot pursuit chased a car thief across the Potomac River into the District of Columbia. Unfortunately, the police officer lost control of his car and struck a pedestrian, severing their legs. When sued by the victim, Arlington County tried unsuccessfully to plead sovereign immunity under Virginia law, which was held only to apply to acts occurring in Virginia.

Actually a Virginia Beach Garbage truck driver ran over a man sitting in a chair on the beach, killing him.
He was never punished.
