If Obama DECLAS’d the documents and allowed Joe to possess them, they would have had to, by law, been registered with NARA.
If Obama had kept the documents in his possession (like Trump did), he would not have had to tell NARA.
This is how that law reads.

Recall also that O’Bungles issued an EO that said you can’t retain/hide embarrassing files by slapping the “CSI” label on them.
