The U.S. Supreme Court declined Monday to consider an appeal by the city of Waco and McLennan County in lawsuits filed by bikers arrested in the 2015 Twin Peaks shootout that left nine bikers dead and 20 injured.
Attorneys for the defendants asked the U.S. Supreme Court to review an April decision by a three-judge panel of the 5th U.S. Circuit Court of Appeals that reinstated the lawsuits of about 90 bikers whose civil rights cases were dismissed last year by U.S. District Judge Alan Albright of Waco.
The federal appeals court panel reversed an Albright ruling that held a grand jury’s indictment of the 90 bikers “served to break the chain of causation” for their false arrest claims and sent the cases back to Albright for further action in the wake of the court’s ruling.
Dallas attorney Don Tittle, who represents most of the bikers, said he was not surprised by the Supreme Court’s decision not to consider the appeals.
“The arguments advanced by Reyna and the city defendants always seemed like a Hail Mary to me based on existing law,” Tittle said. “I guess these days with the different make-up of the judges on the Supreme Court parties are throwing anything out there with the hope of decades-long precedent being struck down. The defendants were essentially arguing that 50 years of civil rights laws should be struck down.”
Waco City Attorney Jennifer Richie said the cases are still in the preliminary stage.
“At this time, the U.S. Supreme Court decided not to consider the issues we presented” Richie said. “They could take up these issues at a later time.”
Dallas attorney Tom Brandt, who represents McLennan County and former DA Reyna, said Monday that “we will proceed with our defense in the district court.”
Back in play!

A cluster mess if there ever was one.
Cops just wanted to get to shoot some people. Odd that it’s in the same area as the Branch Davidian massacre. That Waco water is making the coppers go crazy!
Thank You for keeping us all informed.👍

Good, I think those corrupt folks need to be held accountable for what they did, murder at the site, then the BS afterward. The bikers, good or bad, need justice from this mess.
Although I don’t care a whit about the Banditos or Cossacks, LEOs can’t be allowed to get away with ambushes like that.

He’s sitepesting on another Texas thread (the Houston taqueria vermin exterminator).
Baloney. Bunch of idiots caused the problem with their childish sorority rules about motorcycle clubs. The gangs run a racket and you have to kiss the ring of the lead gang if you want to have a motorcycle club in whatever area the lead gang picks. Hell, if your jacket patches are the wrong color or the wrong design, they will attack you.
Cops were right to watch them and sure enough the fight started, and they came out with weapons.
No different than MS-13, Bloods or Crips.
Glad they kept em out of Waco. The idiots were endangering people getting out of church who just wanted to get lunch.
The specific civil rights claim at issue was for the false arrest of individuals who denied being members of any motorcycle gang or of having committed any crime and who were arrested, indicted, and held on false and inadequate facts. In essence, the case was about innocent people who were mistreated by government officials.
They were there and tried that “didn’t see nothing” mutt thing. They even refuse to identify themselves.
Anyway, cops and DA chased than out of Waco.
It was a gang conference.
I stand wit Even Knievel. The morons ruin the image of motorcycling.
You sound like the type of person who hears “biker” and automatically paints them all with the “evil, drug dealer psycho killer” brush. Glad to know.
So you are supporting government agents killing American citizens, who were not accused, charged or convicted of a crime, from ambush, just because they are bikers? Any other groups you think it’s ok for the government to kill without silly things like due process?
As for what actually happened, although motorcycle gangs were there, so also were independent motorcyclists. Anyway, simply being a member of a motorcycle gang is not itself illegal.
Ah, understood.
Thanks, bro. Been a while since I’ve seen anything on this.
I usually agree with what you post, but can't here. The police instigated this to try and set up Bandits. You don't need to like Bandits but they don't deserve to be entrapped.
Bad part is the police killed more of their accomplices than they did Bandits. Cossacks were chumps.
“The police instigated this to try and set up Bandits.”
Baloney. The Banditos were racketeers, there presiding over the meeting where the crime turf was apportioned, and everyone had to agree to the bunco, terms, rules and taxes to be “allowed” to ride in certain areas without being attacked, thieved or shot. Intel had the other criminal gang coming in also. Both sides were there armed to the teeth for a fight. Cops were there to hopefully stop it.
The scrotes started the shooting and the cops finished it 1930s style, everyone going after someone with a gun or a knife got dumped. It was some fantastic shooting, no innocents got popped.
It’s right up there with the Rangers cleaning up in the oilfield boomtown era.
They can dish it out but they sure get mad when it happens to them. Always crowing about “their” territory, and pushing that outlaw persona. But when it blows up in their face, they sit meekly and make believe it was a mere advocacy group, discussing their lobbyist plans.
By the way. Is it a fact or not? If a club wears a patch with the wrong color or design in that area, without “permission” of the local criminals, would they be at serious personal risk of violence or not? I know you know the answer even if you don’t wanna say it.
People dislike dope, human trafficking, prostitution, getting your bike and car ripped off, etc. But then they act like these guys are some kinda patriotic heroes. That is their business.
It wasn’t a set up. The fight was gonna happen just the same if the cops weren’t there. This was in a nice area by the mall. People go to cracker barrel next door after church. Good decent people could have been hit or abused.
THAT is who Waco PD was protecting.
Just my 2 cents worth. Knievel had their number.
Except is was. Police wearing Cossack rags and the police encouraged them to show up at this meeting they never attended, for good reason. And the police weren't there to monitor the meeting, they were set in shooting positions. Most of the people were shot by police ARs and some were shot by Cossacks. The Cossacks, with their police under covers instigated the trouble. There was only one criminal trial and that Bandit was found not guilty. Why did it all stop after that? And yes, there is issues between clubs about patches. But I was around some of this back when. Just some gut on a bike with a leather jacket and a good looking girl friend. I stayed out of their business and they were friendly enough. I didn't go out of my way to hang out where they were.
