This is what caught my eye in #1329.

A Massive Fraud of this type and magnitude allows for the termination of all rules, regulations, and articles, even those found in the Constitution.

The Constitution is a contract. Under contract law, a contract is vitiated by fraud. Once the contract is broken, it no longer applies. This can have several effects.

• The states would be free to leave the Union to create their own political arrangements. Of course, the Civil War Precedent would also apply in the form of Texas v. White, which would permit the federal entity to do what it pleased to keep the Union together. Lincoln had only two weapons of mass destruction -- Grant and Sherman -- and he used them both. The federal entity has infinitely more weapons of that kind.
• The Constitution could be set aside with the old Articles of Confederation as a backstop until the states believed the Constitution could be restored. That would probably come after an Article V Convention to create new amendments aimed at securing the federal entity in the constitutional prison that James Madison designed for it.
• Finally, the Constitution could be set aside by authorization of the states due to fraud, and the military could come out of the barracks by that authorization to set things right.

I don’t see this as destruction of the Constitution. And I don’t see that considering it a Contract that is broken (it’s already been violated how many times???) nullifies it.

To me Trump is clearly saying in this case, an extra-Constitutional remedy must be used.
