He was charged with elder abuse … which typically means he wasn’t a random stranger assaulting an old person. It is possible the police chief misspoke or assault is covered in the statute. In Illinois assaulting someone 60+ brings more serious charges.

The problem there is that the prosecutor has to prove that the perpetrator knew the victim’s age.
