Joe surmised that the standard of proof for a federal search warrant is higher than in state courts. The guest, a former US Attorney, had to explain to Scarborough that “the Fourth Amendment is the Fourth Amendment is the Fourth Amendment,” and that the standard is the same in state and federal courts.
Scarborough has a shtick of claiming, with supposedly false modesty, that he is a “simple country lawyer.” Turns out, maybe he has what to be modest about!
