If China Joe is forced out of office or otherwise leaves office prior to the end of his Term, Harris would then ascend to the Presidency (God help us all) after taking a new Oath of Office as POTUS and under the 25th Amendment can nominate a new VP and if both the House and Senate approved the nomination by simple majority vote, that person would then be sworn in as the new VPOTUS.
There is a lot of talk lately about the possibility of Obama either being nominated as VP or becoming POTUS again via Presidential Succession via the 25th Amendment either from being an appointed VP by Harris or if he were to be first elected Speaker of the House and if China Joe would leave office and Heels Up Harris was also either to leave office or refuse to become POTUS and remain as VP.
While Obama is constitutionally ineligible to be elected POTUS again via the 22nd Amendment and constitutionally ineligible to be elected VPOTUS via the 12th Amendment, there is a constitutional gray area as to his becoming VP via appointment/nomination or becoming POTUS again via Presidential Succession as a appointed VP or via being Speaker of the House via the 25th Amendment section on Presidential Succession.
While the 22nd Amendment bars Obamaramadingdong from ever running for POTUS again, it does not bar him from becoming President again via Presidential Succession and finishing out Biden’s (or Harris’s) Presidential Term. He would just be prohibited from running for re-election in 2024 and have to leave office on January 20, 2025.
The window Obamaramadingdong can possibly pull off this coup would be anytime between now and January 2nd, 2023. The new Congress is sworn in January 3rd and likely the GOP will formally take over control of the House and the new GOP majority likely electing Kevin McCarthy as Speaker.
