A California woman has sued police in the Bay Area for allegedly using excessive force after part of her scalp was ripped off by a K-9 that mauled her 'for several minutes' until an officer had to physically remove its jaw from her head, following a robbery at an Ulta beauty shop.
Talmika Bates, 26, claims she was traumatized by a German Shepherd named Marco after it went after her and chewed on her scalp during a shoplifting arrest on February 10, 2020, according to the lawsuit filed Tuesday.
Bates, who was 24 at the time of the incident, was on the lam after she robbed about $10,000 worth of cosmetic products from an Ulta Beauty Supply store, along with two other women. The suspects fled the scene by car and ran out of the vehicle after police had chased and attempted to stop them.
Brentwood Police Officer Ryan Rezentes had to pull the police dog away from Bates' head after it didn't obey commands at least twice, according to reports.
The moment was recorded by officers' body-worn cameras and released by Bates' attorneys. In the footage, Bates can be seen hiding in a field among some bushes before police respond to her screaming after they unleashed a K-9 to find her.
After finding her and biting her head, Marco finally lets go and Bates was assisted by officers to get out of the bushes. Her skull was partially red as parts of it no longer had any scalp on it and her hair was also torn off.
'My whole brain is bleeding,' a shocked Bates says in the graphic video.
The lawsuit cites Rezentes and other officers from the incident as responsible for not warning Bates of the K-9 being unleashed to find her in the bushes.

1) The dog shouldn’t be biting head and face.
2) The dog did not respond to the officer’s commands to let go and return to his side. He had to pull the dog off.
3) The officer claims he was delayed in pulling the dog off because he had no cover officer, but that cover officer was there, his body cam filmed the incident.
This badly trained dog is still working.
The sad part is these dogs used in police work cannot be 'retired' easily because of their training, and most times have to be used until they are too old to be of service, then put down.
Of course you are correct. The breeds also have very different levels of motivation and prey drive. My American “show” line GSD’S just lay around and napped a lot. If you want one that will work, you have to go to Europe.

In the sincerest way I say good for you. German Shepherds are just awesome, beautiful dogs. I have nothing but admiration for Belgium Malinois’ also but they are definitely meant for only certain owners as their level of intensity and required exercise is extraordinary.

There was a local K-9 deputy a few years ago. Nice guy who suddenly passed away 10-12 years ago. His dog seemed to have a temperament problem. Growled at kids, people walking by, etc. There were complaints about it, as it nipped at someone. After the dog got a replacement K-9 deputy and he worked with the dog, it was like night and day - the dog was not growling at kids, or people just walking by. Still did his work well. He was retired a few year ago and ai believe is still alive.
If these points are true, then the officer can be — and I think should be — held civilly liable for his unleashed, uncontrolled vicious dog attacking an unarmed person (we’re not talking about a felony here), just as you and I would be held liable.

Another case of some low-life subhuman non-thinking trash believing she has a right to run/fight the law. So of course it will be the police that will pay the penalty of her actions. I am so tired of this BS. There is no reason this moron should be allowed in a courtroom other then to sentenced.
Since these types of situations (struggling when subjected to force) come up quite often, how exactly do you stop struggling when a dog is clamping down on your head or the like (causing physical pain)? I don't think a Zen master could do that. Just sayin', mind you.

Daily Mail-UK falsely pushes the lawyers’ attempt to minimize the crime. Useful facts from another article:

She pleaded GUILTY TO FELONY GRAND THEFT and recently resolved her criminal case. Court records show she spent 120 days in jail and is on probation for a year. The Contra Costa County District Attorney’s Office shows that her restitution amount has not yet been set.”
Yep, here in Tulsa a scumbag stole some beer from a convenience store. A security guard followed him outside. (It's all in the black part of town.)
The thief pulled a gun. The security guard pulled a gun. The guard fired. The thief died.
One less shoplifter.
Might not be pretty, but it's definitely an answer to shoplifting.

I always like a story with a happy ending.
So, she steals merchandise and then makes some additional money on the side suing the innocent people who tried to stop her. Looks like a good deal for her. Plus the untold amounts of money in benefits that we already paid for.
This is because of democrats who think the “oppressed” underclass should be able to waltz right in and take what they want from their “oppressors.”
