What \law\ allows a pharmacist to not fill a script presented by a patient.

If a pharmacist has a legal duty to inquire of the diagnosis, who would be legally bound to answer it; the doctor or the patient?

A pharmacist can refuse to fill any script, at least in the states that I am familiar with state pharmacy regs. No overarching federal law requires a pharmacist to fill a script, however, some states may.
A customer may look high or drunk, and although the script looks valid, the pharmacist may refuse to fill a narcotics script. Some pharmacists may refuse to fill abortion pills or birth control pills on ethical grounds. Or a pharmacologically duplicate script. Or the state board could pressure pharmacists with action for filling legitimate prescriptions for ivermectin or hydroxychloroquine. “Sorry, we don’t currently have that in stock,” works pretty well in most instances.
#3 is moot as there is no legal requirement.
