It is listening and recording all of the time. I said this to someone and they said it only listens when you say "Alexa"...then I said how can it only listen for that phrase? They were like, "Duh...."

The idea is it only responds when you call it’s name.
It can recognize "Alexa" (or a couple other alert words) locally. After that word is recognized it will pass the rest to Amazon for further voice recognition. It will report an error if you say "Alexa" but it doesn't have an internet connection.
How can it listen for the phrase “Alexa” unless it is listening all the time? Deep thinkers are not in abundance in our nation.
The SW on the machine in your home listens all the time but sends no info over the network.
It only uses the network to do voice recognition of the request itself on cloud based computers and formulate a response. They keep that data to improve the cloud based AI.
Fwiw, I won’t have one in my home.
