Follow that logic.
Separation of Powers.
“We The People do ordain.”
Not specifically named in the Constitution “are reserved for the States or >>The People<< [10A]
Ever think it interesting that “THE PEOPLE” literally bookends the U.S. Constitution, as first written?

Executive branch can’t mandate the private sector, either.

We The People...Separation of Powers.

** Executive branch can’t mandate the private sector, either. **

He's doing an end-run around the Constitution. he already admitted he couldn't mandate.

and he hasn't directly mandated the private sector. (Kinda like the non-treaty treaty with Iran.
He's taken it out of the realm of the Constitution and put it in into a regulation.

The 10th says a little more than that.

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."

It doesn't preclude the states from enacting a mandate - the 14th amendment should stop that - due process and equal access issues - yet nobody has gone after the 20 states with targeted vaccine mandates.

A POX on all their houses.
