Some comments by Brian Cates regarding vax mandates, status whether for whole country or not still unclear to me. I haven’t been studying up all day because cooking etc. I’ve often wondered about his conclusion as well. I figured it would be fought and defeated in courts and/or Action would happen before the fines and so on. What bothers me is the military, this suit and court decision doesn’t cover the mil.

JUST IN - Federal Court of Appeals just issued a temporary halt to Biden’s vaccine mandate, Texas Governor Abbott announces.
5th Circuit panel believes the OSHA vaccine mandate has “grave statutory and constitutional issues”. Biden admin ordered to respond by 5 PM on 11-8-21.

Texas challenged the OSHA vax mandate rule on constitutional grounds. The Court agreed to stay the enforcement of the OSHA rule while the constitutional issues raised by the petitioners is litigated in the courts. This is for THE ENTIRE COUNTRY, not just TEXAS.
This is all just a bluff. You cannot forget that. It was a bluff before they drafted this stupid OSHA mandate and it’s still a bluff now that they put in the federal register. BLUFF BLUFF BLUFF. They knew this would never be enforced, that the courts would kill it. It was about bluffing businesses into doing vax mandates on their own.
Remember what the BIGGEST LIE Joe Biden has told in his 50 years in Washington DC: “I don’t know that yet.” And then he suddenly claimed he DID know that he could institute a vax mandate. And he’s lying BOTH TIMES, when he says he didn’t know if he could do that and when he says he found out he could.
We’re about to see if the Biden administration is going to ignore the courts on this.
By what mechanism would Biden enforce the vaccine mandate via this OSHA rule in over half the states if the courts rule it’s illegal and unconstitutional? Hell, how does he enforce it in the blue states?
There’s no mystery here. There’s no suspense. The mandate is UNENFORCEABLE.
As many of you are pointing out in the comments here, the problem is that corporations and businesses are enacting their own private mandates and firing people for not complying. They’re not doing that because they are already being fined by the federal government if they don’t. THAT RULE HASN’T EVEN TAKEN EFFECT YET. And it’s NEVER GOING TO. That means when these corporations and businesses are SUED by the people they fired, a significant exchange of wealth is going to occur.
On some things Obama got away with ignoring the courts. Because Obama didn’t face ANYTHING like the organized resistance in the states that Biden is seeing now. Obama ignored a court order about grabbing too many acres for wetlands? He could get away with that. Who the hell was paying attention to that issue anyway?
THIS vax mandate is an issue the entire freaking COUNTRY is paying attention to. The courts tell him he can’t do it, it’s not constitutional, what’s he going to do? He’s already polling below 40% even in the Fake News Media’s polls. He’s actually below 30%.
He’s got no clout. No leverage. He can’t sneak it by anybody. But the people who’s job is to make stuff look 10 times worse than it is will keep you all deathly afraid and outraged over a phantom. It was NEVER GOING TO HAPPEN. And the private corporations who stupidly went early and instituted their own stupid private vax mandates are going to be left holding the bag. The backlash is going to be epic.

A coalition including Missouri, Arizona, Nebraska, Montana, Arkansas, Iowa, North Dakota, South Dakota, Alaska, New Hampshire, Wyoming, and five additional private entities (the “Coalition”) filed suit in the 8th U.S. Circuit Court of Appeals arguing that the power to compel vaccinations rests not with the federal government, but with the states. The Coalition argues that OSHA’s ETS goes beyond workplace safety and into public health policy, which the states assert exceeds OSHA’s statutory authority. Lawsuits filed by Texas, Louisiana, Mississippi, South Carolina, and Utah in the 5th U.S. Circuit Court of Appeals, Florida, Alabama, and Georgia in the 11th U.S. Circuit Court of Appeals, and Kentucky, Idaho, Kansas, Ohio, Oklahoma, Tennessee, and West Virginia filed in the 6th U.S. Circuit Court of Appeals similarly challenge the legality of the OSHA ETS.
Kentucky, Ohio and Tennessee also filed suit challenging the Biden Administration’s mandate requiring federal contractors to be vaccinated. The lawsuit sets forth similar bases to challenge the federal contractor mandate, alleging that the police power to enforce vaccines rests with the states, not the federal government. Likewise, the states assert that the federal contractor mandate exceeds the President’s statutory authority.
