By causing an employer to inquire of an employee’s non-work related health status in order to continue working is making the employer and agent of the State.
As an agent of the State, the employer must protect the employees 5th Amendment (providing evidence) guarantees, just as OSHA is constrained by the US Constitution..
If, while acting as an agent of the State (adjunct deputy of OSHA), the employer summarily dismisses the employee for not cooperating with the employers request, this is a violation of the employee’s 4th Amendment protection of due process.
What is the most disgusting, for me, is that no lawyers are coming forward to defend the US Constitution.

Under the OSHA standard (1970 & as amended), is an employer required (mandated) to establish a drug tolerance program/policy?
Or, do employers institute said programs as policy? (Honest questions, here).
Can a company be fined for not having one?
Does this regulatory requirement define which drugs are harmful to the employees in the work place?
Does it provide guidance on how to carry out such a scheme (my experience is random, blind testing).
Now that marijuana is approved for “recreational use” in Michigan, are all employees required too prove they have not used marijuana in their home and provide evidence of a negative test each week?
Obviously, people working with MJ in their system are a safety hazard in the work place, as much as employees who come to work with COVID in their system.
