Not according to some lawyer’s opinions I have read. Under the law, as written and interpreted, Baldwin was responsible to check any gun he was going use and the charge is negligent homicide.

He also violated the safety rule about never point a gun at someone you don’t intend to kill — and since the lady was not an actor, there was no justifiable excuse for even pointing it at her, let alone actually pulling the trigger.

My understanding is he was pointing the gun straight into the camera and firing. It was part of the scene to be filmed. She was behind the camera.
