IMO this is unconstitutional! This constitutes a law enforcement organ AND a secret police.

The Constitution outlines a separation of powers between the legislative, the executive and the judicial. The legislative passes laws within the framework of the Constitution; the judicial examines those laws to determine whether they actually pass Constitutional muster; the executive executes those laws consistent with the Constitution and its Bill of Rights.

The legislature could pass a law that security of the Capitol grounds and its inhabitants requires an enforcement arm capable of maintaining order and defending against armed insurrection, even to the extent of a paramilitary organization with appropriate protective gear. The legislature then would provide financing to achieve that mission.

Constitutionally the duties of carrying out that mandate - executing the performance of that law - would fall to the executive branch, the same way that international security falls upon the military, under the chief civilian command of the President. Such execution could include the power of arrest, the job of riot control, imprisoning unruly miscreants; it could even extend to investigating disruptive elements of society to determine if they pose an imminent threat to the Capitol precinct.

All these duties can be carried out by the Justice Department, the FBI, federal prosecutors and the federal prison system, aided by the federal courts to issue warrants and sentence law violators.

The only place the legislature enters the picture is to ask the DoJ to investigate what its needs might be in any given situation, pass the needed laws - under the Constitution - and pass financial support to accomplish the mission. If the threat to Capitol security is too great, the legislature can petition the President - the executive - to call in the national guard, a military action group, to support Capitol security.

Can anyone see a Constitutional role for the legislature to muster an enforcement arm of their own riot police? Further, for said federal police enforcement to arrest possible law breakers and house them in the D.C. City Jail - where they might be deprived of their right to an attorney, a right to face their accusers, a right to a speedy trial - and a right to fair and humane treatment by their jailers. After all, the federal govt does not pay the city's police enforcement bills nor is the city directly answerable to the federal courts and vice versa.

Furthermore, the legislature now proposes to set up an arm of the 'Capitol Police' to organize investigative offices in various states to monitor potentially disruptive groups and prepare corrective measures. Interstate investigative functions are always carried out by the DoJ, the FBI or some appropriate federal agency as specified by laws passed by the legislative branch.

The Capitol Police force has been accepted as a local federal arm based on Capitol Hill; its functions have been as much for hospitality as well as security against unruly citizens and drunks, overseeing order for traditional historical functions as well as property security and loss.

It seems obvious that Speaker Nancy Pelosi has seized an opportunity to organize her own 'justice department' as well as a paramilitary force - and, that she seeks to expand that force to an interstate investigative 'secret police' with unspecified (unlegislated) powers.

Since Republicans are incapable of challenging anything as complex as Constitutional violations, we need space aliens that are willing to stand up and face the powers that be (the U.S. Congress) with a legal challenge to such a power grab, to take the issue to the federal courts, whatever is needed. Citizen groups such as Oath Keepers and Three Percenters as well as patriot and veteran groups will be clubbed and whisked off to unknown dungeons and held incognito indefinitely.
