Used in the body as a drug or device. The FDA does not regulate research laboratory use, that would fall under OSHA, DOT (for transport), or the EPA.

I was speaking of the use if nanoparticles in FDA cleared products. Guidance documents are on their website if you want to bore yourself, it’s a long read.
