Pence’s choice, while regrettable, was not the real issue. Had the state legislators done their job, neither the USSC or Pence would have been necessary to stop the coup.

Pence likely knew of/was in on the coup.
He could’ve very well sent the fraudulently arrived results back to state legislatures. It was his duty.
He failed the country and has sullied himself in the annals of American history.

State legislatures from five states wanted a 10 day pause from Pence so they could review the legality of the certification (long letters). (Sen. Cruz also requested a ten day review) -- Remember, Jan 6 is a date set by Congress, not the Constitution.
Pence, without the authority to do so, said no.
Pence also stopped any objections to a count when congress reconvened after the "insurrection". He essentially broke the law ---needless to add without authority.
