That’s one of the limited circumstances. DC was argued to still be a war zone since there were still Confederate troops fighting, so the assassination was an act of war. And it was controversial at the time..
And if we agree that China attacked us with a biological agent, aided by domestic traitors, isn't the whole country a war zone?
Why should the civilian courts be trusted to handle such trials after they collectively refused to address all of the election fraud?

There is no war declared. There are no resolutions. The US isn’t legally a war zone. The Civil War was an actual declared war with the rules that go along with that.
I think you’re conflating what you think should happen with what is, realistically, going to happen.
