There is no war declared. There are no resolutions. The US isn’t legally a war zone. The Civil War was an actual declared war with the rules that go along with that.
I think you’re conflating what you think should happen with what is, realistically, going to happen.

Was Pearl Harbor a war zone when the Japanese dropped the first bomb on Dec. 7, 1941, or did it only become one the following day after Congress declared war on Japan?
FYI, the constitutional definition of treason is "levying war against [the U.S.] or in adhering to their enemies, giving them aid and comfort." It doesn't require a declaration of war from the Congress for a person or group of people to commit treason.
