Washington D.C. police are offering $10,000 for any information about 42-year-old Maryland resident Kenneth Miles Davis' whereabouts
Police say Davis shot a woman in a road rage incident on May 19 while her two kids were in the car
The driver was struck in the shoulder and a 5-year-old was hit by the shattered glass while the 11-year-old was traumatized
Surveillance footage from the event shows Davis getting out of his car and approaching a gray sedan that he starts shooting
He then turns back and begins to shoot the car behind him, before getting into his Maserati and making a U-turn
Once apprehended, police say, Davis will be charged with assault with a dangerous weapon

Two questions:
1) You had a gun velcroed to a SUN VISOR?
2) Which way was the dashcam pointing? Towards you or towards the front of the car? Most times its pointing forward, towards the front of the car. How would that help your particular situation?
Yes, the camera was pointing forward, however it also records voice so I have him screaming and yelling then after he saw the gun and blew a gasket he pulls in front to make call and take a picture of the front of the car.
Being afraid I slowly lowered the visor not touching the gun in any way (cop said I did good by not touching the weapon) then slowly raising it was when he went off. If he said I pulled the gun out you'd have heard the velcro ripping sound of the safety strip holding the gun in place on my dash cam.
PS: I think now that I’m going to get another dash cam positioned on the passenger side aimed at me so it’d pick up anything from that angle out my window.

I ain’t no lawyer, but that doesn’t sound right. If there is a “plan” I agree it is much easier to sway a jury to the more serious charge. And if that is what you meant, then sure.
A prosecutor may try to say that his arming himself is evidence of premeditation, but that alone will not work. Defense will have precedent against that. So he will back it up with something else like showing his sticker that says “We don’t dial 911” or a “Rambo t-shirt” or a blog post or comment advocating violence including self-defense. If he can show a history of “car crime” road rage, assault charges or protective orders, then look for the jury to convict on the greater charge (unless defense adequately counters.)
Mas Ayoob tells the story of a security guard who went to work one night and killed an unarmed (?) intruder. They charged him with murder because he was wearing a t-shirt that night which said, “Killing is my business, and business is good.” He would have been convicted (true) Ayoob says, but they got him off when his wife testified that she had given him the shirt as a birthday present that very day, “because he loved that movie, Major Payne, and they thought it was funny.”

One of the most remarkable things about Miles Davis is how he attracted the most talented musicians, and gave them room to do their thing. Bill Evans, Jimmy Cobb, Paul Chambers, Cannonball Adderly and John Coltrane, and oh yeah, Miles on trumpet! What a line up.
