The owner of the home said she was renting her residence to a group of four people who said they were from Colorado, and she had told them they were not allowed to have parties.
After neighbors complained about the noise, the homeowner checked her security cameras and saw dozens of people inside of her home.
The Sheriff’s Department assisted with the closure of PCH to ensure that resources could reach the residence, Haralson said.

There are local contractions such as this elsewhere. For example, New Yorkers call the Brooklyn Queens Expressway, BQE, rather than saying the entire formal name.
Can you have vacation short term renters sign a waiver that they are choosing to stay in an old house with any potential injury risks that could occur from same? You could include in the waiver receipts from within the last year for roof, electrical, plumbing inspections, say?
I don’t see why the owner is liable. There should be a way to cover your butt if there was no negligence.

From the YT video, the deck looks to be way out of code. You can see that the house next door has a deck in poor condition too. The pillars look totally inadequate, and that’s not taking into account the years of ocean spray it has gotten. Amazing that homeowners weren’t warned. In my neck of the woods, you can’t get a contractor to repair deck - it can only be replaced due to code.

The lawyers will get a structural engineer in there. This has big money settlement written all over it. She rented the place out, she’s cooked. The homeowners insurance would need a rental rider on it.
The insurance company will get out of it the best way they can claiming they do not cover rental liability. They’ll get dinged too.
There’s different laws in different states. I’m only familiar with NY, NJ and PA...and in these states, landlords should have a basic rule of thumb: in court, the judge will invariably side with the tenant, period.
Assume that you the landlord are liable, even if it’s clearly written in the lease that the tenant must not have parties or whatever he did that led to him suing you.
No waiver, no hold-harmless clause will protect you.
Nothing will protect you when the judge is inclined to decide in favor of the tenant. (See rule of thumb.)

NY is on the verge of passing a version of statewide rent control. Also a “good cause” regulation where you have to even show “good cause” for simply not renewing a lease for an existing tenant. It will have the effect of lifetime rental agreements with the landlord virtually unable to get an existing tenant out even when the property is sold. We are still under a statewide no evict due to COVID until the fall.
Moronic regulations like this will cause a statewide housing shortage worse than what is happening now due to city flight as landlords simply stop renting property and new rental properties not being built.
