What to Expect from Trump's Upcoming Impeachment Trial

Here is a preview for thinking Americans of some things to look for.

The U.S. Senate is scheduled to begin a trial on impeachment of Donald J. Trump officially announced for "the week of" February 8. According to C-SPAN, that means 1:00 P.M. EST on February 9, 2021. C-SPAN allows you to watch, live or whenever is convenient on demand, on a special web page.

The news media have been in a fit over whether or not Trump (his lawyers) will argue that the 2020 election was stolen. Don't bet the farm on Castor and Schoen being that brave, because most lawyers are really not. But typically trial lawyers would be mystified by the question "are you going to argue A or B?" As my law professor asked in a (pretend) stunned expression: "Why do I have to choose only one?" A good trial attorney would be required to hit and smash each and every accusation against his client, in a row. Leaving any accusation alive is not in a trial lawyer's DNA.

Amazingly, though, Trump's brief reminds us that the Democrats are actually required to prove that the election was not stolen. The articles of impeachment do not merely open the door and allow Trump to prove there was election fraud. They accuse Trump of falsely claiming there was fraud in the election, thereby inciting protests.

Can you cry "fire!" in a crowded theater? Well, is there in fact a fire? Then yes. A prosecutor would have to prove there wasn't any fire.

In order to prove their case, the impeachment managers are actually required to prove that Trump's statements were false. The burden of proof is on the Democrats to prove that there was no fraud anywhere in the election.

Trump must shine the spotlight on democRAT corruption in the stolen election with no MSM to in the way. The MSM is going to try to twist anything he says into a confession.

Some Constitutional experts have said that’s not the case, as this isn’t a legal trial. It’s strictly political and they can make up the rules as they go along. That includes not letting Trump’s lawyers even speak — just cut them off the minute they open their mouths.

I hope you are right!! I’m not holding my breath that this will be fair in any way.

SO VERY TRUMPIAN: Trump's impeachment defense brief lets Democrats
know "they" themselves are required to prove that the election was not stolen.

The House's drafted articles of impeachment brought this on themselves:

<><> the articles accuse Trump of falsely claiming there was fraud in the election (thereby inciting protests).

THE REASONING GOES LIKE THIS: Can you cry "fire!" in a crowded theater, if in fact there is a fire?

If this was real trial based on an actual crime this article may make sense. The reality here is this is a fake trial based on emotion run by idiots with a known outcome that means nothing.

Democrats may one day rue the day they won the House, Senate and White House......and both seats in a Georgia Senate runoff.

Yet even to the unpracticed eye of a beholder, the ONE AND ONLY reason these races were (cough) "won" is due to the
machinations of power-mad Democrats pulling off a number of collusive high-jinks for the sole purpose of grabbing power.

Democrats' frightening power-madness has become even more pronounced since the election.

Reining in Democrats is the biggest job Republicans now face. Achieving this will be a challenge
but we, the people, must let Republicans know they will be amply rewarded by a grateful America.

So why doesn’t DC like Trump? He may be rude and crude but he was threatening their money pit. They were cozy with their corruption, and their underhanded ways of becoming wealthy and powerful. Follow the money.

This is a political trial; not a criminal trial. Democrats only have to keep repeating the same lie - that (my) President Trump incited a riot. The Left can be counted on to generate riots and influence the Senators’ vote.

Meanwhile, Leahy will stifle any attempt by the lawyers to argue that the election was stolen. (My) President Trump may very well be convicted and barred from future office. They will own the consequences.
