He has cause to invoke the Insurrection Act and the EO, if it hasn't been implemented already. That had some time period of 45 days after the DNI's report.

The DNI report was due 45 days after the election, but wasn’t submitted until yesterday right after congress certified. Also Trump said today that he was the one who sent in the National Guard.
