When there is a riot, one must first "read the riot act" and tell people to disperse. If they fail to disperse, then authorities can call in the NG. Failing to do that is arguably fascist. So telling people to disperse, does not by itself trigger the next step.

Unless Trump federalizes the guard he doesn’t control them. Pence was presiding over a joint session. He and the Speaker could request assistance from the guard thru the Mayor. Nobody was deposed.
