I agree with Pence on this. He has different paths to take. He can't be tied to a legal action

To me, the more important part of that was the question regarding what the Congressional Act states will be done in case of disputed electors.
That act states that such disputes will go to the electors certified by the Executive part of that state-Gov/SOS. Hence the Act usurps the plenary power of the state legislators which is unconstitutional.
