The Arizona State Legislature has approved a Special Session under U.S. Constitution Article II §1.2 to choose and appoint Electors due to extensive corruption of law in the State.

I think the Michigan legislature has the slimmest majority of Republicans compared to Wisconsin, Pennsylvania and Georgia. Also a group of Pennsylvania and Arizona legislators have met with Rudy Giuliani. I don’t think the Michigan legislators have been as receptive.

We shall see.

Ever hear of the Supremacy Clause? If the legislature has the sole power to choose electors, that power would appear to supersede the state constitution, which limits such power and gives the governor a veto over that power.

Yes, I watched the entire day...it was riveting apart from that one lady that had such difficulty making her point.....I couldn't listen to her drag things out as she did. But the others I found very interesting.

I'm uncertain what they will do in this special session, but they have at least five days to change the certification..

Good - we watched the whole thing yesterday and around 1930 hrs, as they were wrapping up, their guy said they were calling for a special session even as we were watching.

Jenna Ellis was very clear about this when she spoke at the PA hearing. Not sure if she did to the AZ group, but I’d be surprised if she didn’t.

I highly doubt it happens. They don’t have enough repubs to call a special session. I doubt there’s even one Democrat who will do it.

All Giuliani needs is one, JUST ONE state to exercise their Article 2 powers and he has a strong case to take to the Supreme Court.

I don’t believe he needs enough states that bring the total EC votes for Biden under 270.

He just needs to show one state willing to step up and refuse or nullify certification due to fraud or go the extra mile to seat the electors for the candidate they believe is the winner, President Trump.

I started a thread on the issue of Legislative vs. Electoral Sessions of a state legislature:

It has the relevant text of McPherson v. Blacker, 146 U.S. 1 (1892) that set the precedent that the state legislature acts independent of the other organs of a state, such that it is the representative of the state, when appointing presidential electors.

My point is that not all of the powers of a legislature are legislative. In the case of an impeachment, the Senate has a judicial function and the lower house is a prosecutor. In the case of appointing presidential electors, the function of the legislators is electoral. The purpose of state constitutions in places like GA, that require the governor to call the legislature in a special session after certain events to pass new legislation, has no bearing on the prerogatives of the legislature to appoint presidential electors, a federal electoral power. This is not about passing new legislation. No special session of the legislature is required.

Back when drafters of constitutions lived, the memories of tyranny were immediate and fresh. The genius of America is that the ultimate decisions are always constitutionally delegated to either those representatives closest to the people, or to the people themselves.

Unfortunately, too many people today are just like the escaped Egyptian slaves slogging across the desert who wanted to turn back, accept their chains and submit because freedom was just too onerous.
