Let's put this to bed. that's just not true. the minute she was sworn in, she could have voted.
The choice to not participate in a case is hers and hers alone.
You won't see the words recuse or abstain or sick in a decision.
The statement "Justice X not participating" within the decision is a statement that covers all reasons why an Associate Justice did not participate.
