State legislatures, however, have a plenary and nonjusticiable power to choose electors, even if that means overriding the popular vote in the state. The Supreme Court can remand the choice of electors to the state legislature due to irregularities or other issues. This is what the Court should have done in Bush v. Gore in 2000 rather than stopping the Florida recount.
