New guidance from Diana Becton, first-term Costa County (California) District Attorney, states that law-enforcement officers must consider if looters “needed” the merchandise they stole before charging them. And whether a shop is open or closed when the thievery takes place matters, and whether the looting was done because of a "state of emergency" or "just because" makes a difference in who gets charged, too. That the looting happened seems irrelevant.

RedState's Deputy Managing Editor Jennifer Van Laar has a watermarked screen shot of an internal Contra Costa County DA's office internal guidance document called "Looting Guidlines.docx (sic)" that appears to confirm the prosecution policy.

And if all true, it would explain why looters keep looting in the Bay Area, given all the huge loopholes for avoiding any charges. There likely isn't a single charge that can't be dismissed in Contra Costa on these described grounds.

Used to live in that county. Glad it is in the rear view window. At that time and I am sure today too the sheriff would not approve any CCW permits. F em. Just used my g id to carry but really despised that guy. I think our rep then was the commie dem Miller.

For those that know this has been going on long before the riots. There are “homeless” camps near most major box stores. The reason is that these “homeless” can simply walk in and take what ever they want and nothing can be done about it. If you catch them or call the cops the best you can hope for is the cops make them give the stuff back. But the thief is let go.

Most minor crimes (up to $900) is treated like a misdemeanor and if caught they are issued a citation and released. Even when they catch someone with a warrant for their arrest all they get is a citation and let go.

Before you get mad at the politician it was the voters that passed the resolution that allows this.

Diana Becton is a “very powerful tool”. Ordinary, law-abiding citizens have very powerful tools to deal with looters.
