can an NDA be enforced if the signer is aware of a felony being committed by the purchaser?

What about, “This is some sick s**t, I’m breaking the NDA, screw you!” as an American!

Up to the courts.
Not reporting a felony is a felony.
The only inviolable oath is the Confession.

You can’t make an illegal act legal by virtue of a contractual promise. Such a contract is void from the start.
