Does this company operate in an interstate market?
Interstate market regulation is the domain of the Federal government.
The State cannot shut down such trade without violating the Constitution.
In interstate trade, there is no Essential operation or non-Essential operation.
If the State shut them down, they can sue and prove harm; 18USC242.
If they closed according to the State emergency order, they must wear those chains.
But, by choosing to close according to their interpretation of the illegal order, they make redress difficult.
They should open immediately, citing illegal restraint of interstate trade.
