I don't know for sure either, but the last case: Hamdi v. Rumsfeld, 542 U.S. 507 (2004), is a United States Supreme Court case in which the Court recognized the power of the U.S. government to detain enemy combatants, including U.S. citizens, but ruled that detainees who are U.S. citizens must have the rights of due process, and the ability to challenge their enemy combatant status before an impartial authority.
If the accused can challenge their unlawful combatant status, I don't see why they then couldn't be tried via military tribunal. Once in that system, the rules of evidence: 'Military commissions evidentiary rules therefore do not require that physical evidence was obtained pursuant to search authorizations. However, the accused is entitled to the suppression of evidence that is not reliable or probative and evidence the probative value of which is substantially outweighed by the danger of unfair prejudice, confusion of the issues, or misleading the members; or considerations of undue delay, waste of time, or needless presentation of cumulative evidence.
So no FISA req'd, all NSA acquired evidence would seem to be admissable. They got game chat logs after all. What do you think they snagged before Q?
I see beyond the trees on main board the concern trolls are out! This suggests to me that Barr’s statement is having the desired effect ... as long as derps et. al. think that Hussein & Pedo Joe are safe, they’ll swallow HRC + Hunter. Once the ground shifts to that terrain ... it’s just one more step to Hussein. It is extremely important that Barr be seen as implementing fair and impartial justice. Barr also explained how everything about FISA etc. was corrupt & illegal - that is now the ground upon which we stand. That is a HUGE shift in expectations outside of the grander + longer term desires + beliefs. TBD + WWG1WGA :)
I also believe, based on reviewing the Collyer 4/2017 release at the time, that FISA is enforced via MIL and I always considered the means for entree therein + thereby. TBD + WWG1WGA :)
We shouldn't forget the popular view concerning Comey earlier, that he was being left perhaps totally unaccountable. Now the predominant view is there's no way he could be left off the hook concerning FISA and that it surely looks like a coup. If Barry is off now regarding FISA, only to face more solid treason under a different heading (e.g., using the IC and military for Fuddy's faked death), perhaps the goal of seeing Barry pay for his crimes will yet find fruition.
There's such a fertile field of Barry's criminality, it's almost preferred to see the best saved for last, lest we get quick vengeance and leave the media to bury and ignore a dozen other unexplored Barry scandals.
Joe will be gone before we know it. There certainly looks to be plenty of meat in the involvement of all the other Dems on the Ukrainian front. Joe's precedent-setting, extortive demand to fire the Ukrainian prosecutor must not be a get-out-of-jail-free card for the future of the Republic because it went unprosecuted. However, Durham's current charge is probably rightly viewed as an investigation limited to potential FISA wrongdoings.
Nonetheless, if FISA is just the start, so many things are seemingly connected to that, so it's hard to give a whitewash to "I don't expect Durham's work will lead to a criminal investigation of either man."
If FISA is a start, don't other things flow from that, as opposed to each of those things needing to find a brand new genesis?
I do agree a logical interpretation could simply be that sufficient investigation has already been accomplished by Durham. Durham's work won't lead to an investigation of [Barry or Biden], it'll only lead to i's being dotted, t's crossed and grand juries convened to return indictments.
