So anyone else that gets it has to reach that stage before they are ‘allowed’ to have something that probably keeps them from getting to that stage in the first place?

The FDA doesn’t determine what Doctors can prescribe. They only determine if products meet their claims. Doctors have always been able to prescribe off-label use of meds.
State boards control doctors and licensing not the FDA. The State boards are the ones that are preventing the prescriptions.
