Facts & Myths about Arbery Case

I am a veteran criminal law attorney who has tried more than 300 criminal jury trials, handled thousands of other criminal cases, racially-divisive cases, etc. We have dozens of "citizen lawyers" on Free Republic who are posting insane, inane, wrong, and crazy "facts," "law," and conclusions. I have studied this case inside and out. Let me give you some insight, and feel free to post some questions....

I am skeptical that he was wearing boots. I am 100% sure that he was wearing kneelength cargo pants, leather belt, and a bandanna around his neck, at a time when the china virus had not yet hit us. Also, his pants were sagging in the back. In other words, he was pretty much dressed like every black guy that’s been in my office in the last 30 years. He was wearing nothing that would be consistent with him being a jogger.

The entire premise of the father and son grabbing their weapons was because they thought he was potentially armed.

Now the two Da’s that first handled the case are in possible deep shit as the Georgia AG has asked the Feds to investigate their handling of the case.

“Georgia’s attorney general has requested that the US Department of Justice conduct an investigation into the handling of the Ahmaud Arbery case.

“We are committed to a complete and transparent review of how the Ahmaud Arbery case was handled from the outset,” Attorney General Chris Carr said in a news release. “The family, the community and the state of Georgia deserve answers, and we will work with others in law enforcement at the state and federal level to find those answers.”
Carr’s request to the DOJ includes an investigation of the “communications and discussions” between the first two district attorneys assigned to the case, both of whom have since recused themselves.”

I have had thousands of dollars worth of stuff stolen while my Illinois house was being built in 2007, including hard to replace imported Canadian toilets. So, I have no sympathy for criminals exploiting homes under construction.

That said, most of the “valuables” in such a home (uninstalled cabinets and bathroom fixtures, copper pipes, don’t lend themselves to be stolen by someone on foot. Simple trespass of an unoccupied home is a pretty weak offense, and Arbery didn’t apparently have any contraband on him. If he was intending to burglarize the home it is pretty pathetic that he went back to a neighborhood where he has operated before. I guess that “return to the scene of the crime” cliche must have an element of truth to it.

Thanks. It seems unrealistic, even for a runner/jogger to be without some form of transportation that far from home.

Greg McMichael doesn't have to "stick to it". Arbery's criminal record is public, including the weapons charge.

What's your point?

My point, was merely pointing out that the McMichael didn't call the cops when they saw a potentially armed and dangerous felon prowling 'the other night'.

It would appear so wouldn't it?   It is legal to walk down the street with a shotgun in clear view. It is legal to make a citizen's arrest.

But try to work it out for yourself if you are having difficulty.

If you have a problem with that, don't move here.

But you really know that is not what happened.   The younger McMichael did not use deadly force to arrest for a misdemeanor.   He armed himself in case a suspected thief was armed.

He only used deadly force at the moment he was forced to defend himself from being disarmed by a suspected criminal.   The elder McMichael did not even use his pistol which goes to prove they had not intended to commit murder.   Also the fact that they did call 911 proves they did not intend to commit murder.   Their only intent was to prevent a thief from fleeing until the police got there.

The DA Barnhill also stated that Arbery more than likely caused the shotgun trigger to be pulled when he grabbed the gun.
