Because the business is not an individual.
Only a citizen and resident (individual) is protected by the statute.
Businesses are not afforded those rights.

Take for instance, registration of firearms.
Once they are registered they are no longer protected AS WELL AS the owner who registers them.

Whether or not an individual owns a business should have no bearing on that person’s ability to earn a living. That person’s individual rights are being trampled on if the state shuts their business down, because they are no longer able to earn a living.
