The DOJ does not pursue these cases on its own. The first thing that has to happen is that a person or organization that is affected by an illegal shutdown order needs to take the first step of filing a legal challenge themselves. At that point, the DOJ joins the legal action as an interested party in the case. Barr refers to this in his statement.

In other words, the DOJ will not be a plaintiff in a civil lawsuit. That's because the DOJ is not a victim of this government overreach and therefore does not have the legal standing to file a lawsuit. Instead, it will bring its resources to assist anyone else who DOES have the legal standing to challenge these actions.

Individuals have already filed lawsuits regarding church services. So far, the DOJ has interceded in one case, that of Mississippi’s ban on drive-in church services. They need to step up, and get involved in the other lawsuits out there, like the closing of gun shops.
