2. It does start to scare me because the very fact that they are doing it..shows this is something big they are worried about...name the last time they EVER did it.

Everyone is afraid of lawsuits. This probably one reason overreaction.

A lot of what is going on here is hype and fear. People acting on emotion and me too instead of thinking rationally.
