I don’t think you are as the underlying California Code defines an ATD as:
“Aerosol transmissible disease (ATD) or aerosol transmissible pathogen (ATP). A disease or pathogen for which droplet or airborne precautions are required, as listed in Appendix A.”
So they define it as a disease which requires droplet *or* airborne precautions.
I’m hopeful that research will soon show more information on aerosol transmission.

Only pointing out that CalOSHA, which would be a state sub. of the federal OSHA, believes so, and by publication has incorporated it as policy. How, or why, OSHA made that determination, is above my retired pay-grade.
to add to my reply, I would suspect the aerosolization would be after RDS symptoms and not before. Reason being, we don’t have stewardesses or customs agents falling out, but we do have ICU nurses falling out. There has to be a reason for that, seeing how one is completely unprotected and the other is bunnysuited. But again, that is pure speculation.
