This right was taken away by civil rights legislation and court cases over the past several decades.
An excellent new book, The Age of Entitlement: America Since the Sixties by Christopher Caldwell, argues that this right is fundamental to all the others.
Think about it. I won't try and lay out the case here, but it is rather convincing.
Caldwell argues that civil rights, no matter how well-intentioned it was in the '60s, has led to all the other parade of horrors including radical feminism, Roe v. Wade, LGBTQ, affirmative action, political correctness, open borders and fracturing the nation into legally differentiated races.
Caldwell argues that civil rights and all the legislation and court cases derived from it (directly or indirectly) have generated an alternative and competing Constitution, which is the competing legal system of progressivism.
