Dershowitz makes a similar point in his excellent hour-long FoxTV interview with Mark Levin.

Dersh says that the House is violating the Constitution and abusing power if they impeach the President OTHER than for the Constitutionally defined "High Crimes and Misdemeanors."

I had always tripped over this phrase, but he explained that the adjective "High" relates to both felonies (crimes) and misdemeanors.

So you can have a "High misdemeanor."

Dersh suggests that the President could theoretically challenge the House impeachment (before Senate trial) to the Supreme Court, on the grounds that the specific charges they are voting on are not allowed by the Constitution to even be considered as impeachable. (This will probably not happen, but is a theoretical possibility.)

Dersh further elucidates this point by quoting Hamilton, who wrote an essay explaining that a politician may pay a bribe, for example out of their own funds (as Hamilton himself did to silence an affair); BUT, this only becomes a "High crime" if it impinges upon his government powers, such as paying the bribe out of government funds.

Biden, of course, paid the bribe to Ukraine out of government funds ... presumably with the full knowledge and support of Obama. THIS WAS THEREFORE A HIGH CRIME.

Obama likewise paid vast sums to Iran and probably many others, using government money, and for as yet unknown quid pro quo.

The program got me to wondering what could be done to Obama. It's too late to impeach him and remove him from office. I honestly don't think he will be prosecuted unless there is a smoking-gun paper trail of bribes from very bad actors (such as Hezbollah) into his personal bank accounts.

I DO HOPE thia can at least end up as an object lesson for America against ever again electing socialists to national office. Because it will ALWAYS end up in the gutter.

I thought having a big trial with witnesses etc. was ideal . . But I’m now swayed NOT. Senate should dismiss without blinking an eye ... have other hearings + legal proceedings + DECLAS. Don’t afford RATs opportunity for mischief in impeachment trial. Better yet blow them out today and avoid vote in the house. Many options in the plan!

When Trump wins in November and Republicans re-take the House, can the new House rescind or quash this fraudulent impeachment?
