Seriously though, many think there are no constitutional limitations regarding impeachment. They are wrong. The Constitution says impeachment requires the one impeached must have committed a crime (U.S. Const., Art. II, Sec. 4).
Impeachment being a criminal proceeding puts impeachment in the cross-hairs of the Fourth and Fifth Amendments (4A & 5A) which prohibit UNREASONABLE searches and seizures, including investigations. Thus to launch a constitutional impeachment investigation, there must be at least particularized and articulatable reasonable suspicion (RS) of a crime being committed and to proceed at some point there must be probable cause (PC) of the crime being committed. Even a traffic stop requires RS. A cop can't pull you over because he doesn't like you or has a "hunch" you've committed a crime. The cop must have evidence that you have committed a particular violation that he can clearly articulate.
In this so-called impeachment case, Art. II, Sec. 4 doesn't define necessarily what the crime must be, only that it is a crime. The Constitution leaves the definition of a crime up to Congress - the crime being charged is where the scope of impeachment is undefined by the Constitution. So if Trump has committed a crime that Congress has already legitimately and constitutionally legislated as a crime and there is RS and RS to investigate and proceed, then the impeachment proceedings are on solid constitutional grounds.
But what particular crime had the Delusional Dems found that they have clearly articulated to constitutionally justify an investigation of Trump? I know of none. They launched the investigation and proceeded to the impeachment process without articulating or clarifying any RS or PC of a crime, making this whole process unconstitutional and illegal.
Like the horrific Spanish Inquisition, the Delusional Dems impeachment investigation of Trump was launched at entirely will, ignoring the constitutional requirements and individual rights against such unjust government acts as reminded in the 4A & 5A. The Delusional Dems have proceeded as though America was a third-world dictatorship where government at will stomps on and entirely disregards the God-given rights and freedoms of the individual. Today Trump, tomorrow you and I.
The Delusional Dems have tried to make it easier to impeach a U.S. President than to make a traffic stop. After this debacle is over (soon I think), I hope these corrupt and delusional Dems are called to answer for THEIR unconstitutional and illegal acts in this whole affair. I say, "IMPEACH THE IMPEACHERS."
That is from the guy that talked about Ukraine’s daughter being locked up in the basement with duck tape over her mouth
He is an idiot.
When you find yourself exaggerating on an already ridiculous assertion, you know you've lost.
Johnson is also the one who said Guam would capsize if too many people were put on it
The only accurate statement at the end of the hearing came from Congressman Collins,
when he said :" This is a kangaroo court".
The whole matter is just so Stalinesque !
What a pitiful way to waste almost 2 1/2 years of Congressional attention,
and someone should be invoiced and billed for it !
Are they getting ready for the trolls? little mike and the butt boy
They are upset that the President is so EXCELLENT at being president. They are jealous and sore losers, as well as being majorly despicable.
It amazes me that there are so many in the US who are lefty lunatics who are unable to think clearly and critically. We are in the age of nitwittery. Their worthless, malignant “leaders” must be crushed. No quarter for them in this country is to survive. They deserve ridicule 24/7...then, they deserve prison.
One thing I am confused about in the Constitution.
It says “high crimes and misdemeanors.
What about those misdemeanors? To me, a misdemeanor is something like jaywalking. People do it all the time, but it’s a crime.
So did the Founding Fathers make the bar super low when they wrote misdemeanors?
The definition of misdemeanor then was any kind of bad behavior or even bad attitude. The definition in law is about the only use of it today.
And making fun of the Ukrainian President for being a "short" 5'11" - which isn't short. The Dem is retarded.
I don’t know how tall Donald Trump is, but I know that Sleepy Eyes Chuck Todd is only 5 foot 2 inches tall.
And Robert Reich is a midget’s brain.
A misdemeanor is a crime, but with relatively small penalties. A misdemeanor is a “low crime” (vs. “high crimes” like treason and bribery (which D.C. officials commit on a regular basis)).
So impeachment requires a crime (Art. II, Sec. 4) and, thus, is supervised by the 4th and 5th Amendments which requires reasonable suspicion (RS) to even START an investigation for a crime for things like impeachment.
This whole process is unconstitutional from the start as was the Delusional Dems’ first coup attempt, the unconstitutional Mueller investigation (no RS there either).
Thanks, good to know!
Excellent. Thank you, Jim.
I know House elections are popularity contests, more than anything else. Thank Johnson’s constituents must be as dumb as he is. I’d be embarrassed if my Representative was that stupid.
There is no doubt the grounds for impeachment included actions which might not be illegal:
