She killed a man while committing a crime: criminal trespass at best or breaking and entering at worst. Killing someone in the commission of a crime in Texas is murder. She got what she deserved. Race and gender had nothing to do with it.
It fits because of the fact she was in the process of committing a felony (violation of 30.02 - which is a state jail felony) and death occurred. She entered a habitation illegally - thus committing a felony - and that resulted in the negligent death of an individual.
That is the textbook definition of what they charged her with and anything less would have been injustice had it been your loved one shot and killed - CORRECT? That is why they charged her with 19.02.b.3 murder. Remember, there is no 1st or 2nd-degree murder in Texas.
If the victim had not been black, she would have walked away clean.
She is a cop. She couldn’t have pulled that loaded gun, snuck into where she suspected the “intruder” was, pointed the gun at him and tell him to “STICK ‘EM UP!”?
I always keep my doors locked when I am in the house alone as I am an older female and been hearing about a lot of criminal break-ins while the owner was in the house.
Still, the guy did not deserve to die. He was sitting on his couch eating ice cream for God’s sake.
