Senate is not in a recess long enough to allow recess appointment. McConnell has been arranging pro forma sessions each few days, for the exact purpose of stifling recess appointment.

The mechanism the president used to fill this spot was to name an Acting Director. This is facilitated by 5 USC 3345 - Acting officer statute. I've read that President Trump's options were limited for a vacancy in DNI, generally stated that his only option was to name Sue Gordon as acting. I don't know if this supposed limitation had a statutory or personnel basis. She resigned, the usual suspects complained.
