In the sense that the act of Congress allowing a declaration of an emergency is an indication of the mind of the Congress in light of Constitutional restrictions.
If the Congress can convince the court that this declaration is not what they intended, that would weaken POTUS' position. I am not a legal beagle and have no idea how that will fall out.

I am not a legal beagle either. However, I do know that border security has long been held to be a Federal Issue. Also it appears to me the responsibility belongs to the President under the constitution.
The only question is the Dollars spent. Clearly it’s a matter of National Security. In the review of the Omnibus bill several better heads than mine explained how this bill ensured the funds could be used from the military budget-the usual appropriations rules don’t apply to these type of bills.

Congress does not judge by their “intention” as he does not declare one at their behest. Since they gave that authority to him in a primary form, we must also look at the typical flow of the process especially in light of all that have been issued and especially those still in force.
In my opinion those in opposition have “skin in the game” i.e. something to hide, and in this game they are playing their cards now as a result under pressure from their financiers
