Trump still needs funding for a wall in a bill. If Trump has to pull the trigger for the emergency thingy it will be immediately challenged in Court.
Military orders do not require funding beyond what has been appropriated by Congress for the military. It’s a military order, which means its not going to be enjoined by a judge either.
